Starting April 1, 2025, California landlords and property managers can add yet another new legal requirement to their compliance checklist, but this one is actually something you should be doing anyway. PHOTOS!
AB 2801 – which aims to ensure transparency in handling security deposits – mandates photographic documentation of rental units at key stages, adding an extra layer of accountability to property management.
At Lucas Real Estate, we’ve always taken a proactive approach by photographing properties before and after tenancies, making this a best practice long before it became a legal requirement, and always advised our landlord clients (and tenant clients!) to do the same. Nothing beats a “before and after” photo, and this new law basically mandates just that.
Here’s what you need to know about the new law…
Key Requirements of AB 2801
- Photographic Documentation:
- Move-In: For tenancies starting on or after July 1, 2025, landlords must take photos immediately before or at the inception of the tenancy to document the property’s condition.
- Move-Out: Photos must be taken within a reasonable time after possession of the unit is returned to the landlord.
- Post-Repair/Cleaning: Landlords must also take photos after any repairs or cleaning that result in security deposit deductions.
- Providing Photos to Tenants:
- If deductions are made from the security deposit, landlords must include move-in, move-out, and post-repair/cleaning photos with the itemized statement and written explanation of the deductions.
- Photos can be shared via mail, email, flash drive, or a link to a viewable website.
- Limitations on Deductions:
- Deductions must be reasonable and necessary to restore the unit to its original condition.
- Charges for professional cleaning services are prohibited unless reasonably necessary.
Summary
Just take before and after photos! Photos before a tenant moves in, photos after. Take photos before a repair for which you plan to charge a tenant, and after the repair
Tenants, you should be doing this too! (and there’s no legal requirement for the tenant to share the photos with the landlord, so simply keep them saved and handy in case you need them later).
