Fair Housing Foundation Tip of the Month: Rent Increases

In areas without rent control, there is no limit to the amount a landlord can increase the rent, provided it’s done so with proper notice and not being done in retaliation or based on a discriminatory motive.  In Los Angeles County some cities do have rent control (i.e. a maze of ordinances limiting the rental increases and a host of other landlord and property rights limitations) such as Los Angeles, Santa Monica, West Hollywood, and Beverly Hills.  There are no rent control cities in Orange County.  Absent a rent control ordinance, if the landlord wants to increase the rent at any amount they may do so according to the law as long as they give proper advance notice.  The length of notice is dependent upon the percentage of the increase.

The Tenant Must be given:
A 30 Day Notice of the Increase – If the increase, over a 12-month period, is 10% of the current rent amount, or less.
A 60 Day Notice of the Increase – If the increase, over a 12-month period, is more than 10% of the current rent amount.
If you would like to know the ways to give proper notice, call the Fair Housing Assistance Hotline at 1-800-446-FAIR to speak to a housing counselor, visit www.fairhousingfoundation.com, or consult with a real estate professional.
