Use of Floor Plans in Real Estate Listings – An Architectural Copyright Infringement???

In a significant ruling for the real estate industry, a federal court in Missouri has declared that the use of floor plans for marketing homes does not constitute copyright infringement under the “fair use” doctrine. This decision, which is currently being appealed, has crucial implications for real estate professionals, including those in Newport Beach, Costa Mesa, and the surrounding coastal communities.

The Case: Designworks Homes, Inc. v. Columbia House of Brokers Realty, Inc.

The case originated with Designworks Homes, Inc., an architectural firm that sued real estate brokers for using floor plans in their marketing materials. The brokers had included these floor plans to aid in the sale of homes designed by Designworks. Initially, the district court ruled in favor of the brokers, but the plaintiffs appealed, and the Eighth Circuit Court reversed this decision. The case was then sent back to the district court, which ruled in September 2023 that the use of the floor plans constituted fair use.

“Fair use” is a legal doctrine that permits the use of copyrighted material without the owner’s permission under certain conditions. The district court concluded that the functional nature of the floor plans in real estate marketing, requested and consented to by homeowners, did not infringe on the architectural copyrights held by Designworks Homes, Inc.
